Construction Project Documentation: What Records to Keep and Why
The contractor who wins a construction dispute isn't always the one who was right — it's usually the one with better records. An owner who claims the contractor never completed scope X gets nowhere against a GC who produces daily reports, photographs, GPS-verified labor records, and a signed inspection approval for scope X. The same owner wins easily against a GC whose response is "we definitely did that work" with nothing to back it up.
Construction disputes — payment claims, delay claims, defect allegations, OSHA investigations, workers compensation audits, tax audits, licensing board inquiries — all resolve on documentation. The contractor who kept good records has leverage. The contractor who didn't is defending from memory against an adversary with a paper trail.
Documentation also protects in the other direction: a complete project record lets the contractor identify when a problem was caused by the owner, the architect, a subcontractor, or a supplier — and pursue the right party rather than absorbing costs that belong elsewhere. The daily report that records the owner's design representative arriving and verbally approving a substitution, followed by a written email confirmation, is the record that converts that substitution from a contractor's change to an approved scope change when the owner objects months later.

The 10 Categories of Construction Project Records

Category 1: Contract Documents
The legal foundation of every project. Everything else is interpreted in the context of the contract.
What to retain:
- Executed prime contract — signed by both parties, with all exhibits
- All contract drawings (record set — the version in effect at contract execution)
- Project specifications
- All addenda issued before contract execution
- Pre-bid RFIs and owner responses
- All change orders — executed only, with supporting documentation
- Contract modifications and amendments
- Owner-issued bulletins and clarifications
Why it matters: Contract documents define scope, schedule, payment, warranties, and dispute resolution. A dispute about whether a scope item was included is resolved by the contract documents. A dispute about whether a change was authorized is resolved by the change order log. A contractor who can't produce the executed contract in a dispute is starting from a significant disadvantage.
Retention: Minimum 7–10 years from project completion, or the applicable statute of limitations for construction claims in your state — whichever is longer. Some states have 10-year statutes of repose for construction defects.
Category 2: Daily Field Reports
The contemporaneous record of what happened on the project, every day. Contemporaneous means created on the day it describes — not reconstructed weeks later. Courts give substantially more weight to records created the day of the event than to records created later.
What a complete daily report captures:
- Date, weather conditions (temperature, precipitation, wind)
- Workers on site by name and classification (or headcount by trade)
- Subcontractors on site with crew counts
- Equipment on site
- Work performed — specific scope items, locations, quantities where trackable
- Materials delivered — supplier, quantity, cost code
- Visitors to the site — owner, architect, inspectors, with names and purpose
- Verbal directions received — who gave them, what was said
- Problems, delays, or issues encountered — cause, impact, who was notified
- Safety incidents or near-misses

What to retain:

- Payroll registers — gross pay, deductions, net pay by worker by pay period
- Certified payroll reports (Davis-Bacon and state prevailing wage projects) — WH-347 forms for every pay period
- Employee classifications — documentation that each worker was paid at the correct rate for their classification
- Overtime authorizations — written record of who approved overtime and why
- New hire documentation — I-9, W-4, direct deposit authorization, classification confirmation
Why GPS time tracking records are legally significant: GPS-verified contractor time tracking app records are timestamped and location-stamped at the moment of creation — they cannot be retroactively altered without creating a detectable record. Category 4: Financial Records
Every dollar that flows into and out of the project, documented.
What to retain:
- All supplier invoices — received, matched to POs and delivery tickets
- All subcontractor invoices — with supporting lien waivers
- Payment applications submitted to the owner (G702/G703 with all supporting documentation)
- Owner payment records — checks, wire confirmations, amounts and dates
- Change order requests — GC's cost backup supporting each change order
- Executed change orders
- T&M tickets — signed by owner or owner's representative for all T&M work
- Job cost reports — monthly snapshots through project completion
- Lien waivers — conditional and unconditional, from GC and all sub tiers, all periods
Why T&M ticket retention matters: A signed T&M ticket is the primary documentation for T&M billing disputes. An owner who disputes a T&M charge months later gets shown the ticket they signed on the day the work was performed. An owner disputing a T&M charge where no ticket exists — or the ticket wasn't signed — has a credible challenge.
Retention:
- Tax purposes: 7 years from filing
- Lien waiver records: 10 years (lien claims can arise years after project completion in some states)
- Financial records generally: 7–10 years
Category 5: Safety Records
OSHA and insurance requirements make safety documentation one of the most regulated record categories in construction.
What to retain:
- OSHA 300 Log — all work-related injuries and illnesses during the year
- OSHA 300A Summary — posted annually February 1–April 30, retained thereafter
- OSHA 301 Incident Reports — one per recordable incident
- Incident investigation reports — root cause, corrective action, follow-up
- Near-miss reports
- Toolbox talk attendance records — date, topic, attendee signatures
- Safety orientation sign-off sheets — one per worker

Best practice: Retain all safety records for at least 7 years. Medical and exposure records follow the longer statutory requirements.
Category 6: Schedule Records
The schedule record documents when work was planned, when it was executed, and why any variances occurred. Essential for delay claims in either direction — contractor claiming owner-caused delay, or owner claiming contractor-caused delay.
What to retain:
- Baseline schedule — the approved schedule at project start (the agreed benchmark)
- All schedule updates — monthly revisions with narrative explaining changes
- Schedule narrative reports — written explanations accompanying each update
- Delay notices — formal written notices to the owner when delay events occur
- Time extension requests and owner responses
- Acceleration directives — owner direction to accelerate, with supporting cost documentation
- Float consumption reports — tracking which activities are losing float
Why the baseline schedule is critical: The delay claim calculation compares planned completion (from the baseline) to actual completion. Without a preserved baseline, there's no benchmark. A contractor who updates the schedule continuously without preserving prior versions can't demonstrate what the original plan was.
What contemporaneous records prove in delay claims:
- Daily reports showing crew idle, waiting for owner-furnished items
- Labor records from construction employee time tracking app showing workers on site but not productive
- Written delay notices sent within the contract's required notice period
- Meeting minutes documenting discussions of delay causes

Category 7: Communication Records
Every significant project communication creates a record. The aggregate of communications tells the story of the project — what decisions were made, by whom, and when.
What to retain:
- All project emails — every email related to the project, from inception to final closeout
- Formal correspondence — certified mail letters, demand letters, notices
- Meeting minutes — owner meetings, subcontractor coordination meetings, OAC meetings
- RFI log and all RFI documentation — question submitted, architect response, dates
- Submittal log — all submittals, review status, return dates
- Phone call logs — brief written record of significant phone calls (who called, date, topic, what was said), sent to the other party as a confirming email
Why email retention is critical: Email is the primary communication record in construction disputes. A contractor who can produce the email chain showing the owner verbally authorized a scope change — later formalized into a disputed change order — has contemporaneous evidence of the authorization. Missing emails from a critical period create gaps that opposing counsel will exploit.
Email retention best practice: All project email should be organized in a folder structure by project from day one. At project completion, archive the complete email record. Don't rely on individual employee inboxes — when an employee leaves, their emails may be inaccessible.
Retention: 7–10 years minimum. For significant projects, consider permanent retention of key communications.
Category 8: Photographic Records
Photographs are the most accessible and persuasive evidence in most construction disputes. A photograph of completed work before it's covered, damage before and after, or site conditions during a claimed delay event is worth hundreds of words of description.
What to photograph:
- Work completed before it's covered — MEP rough-in before drywall, rebar before concrete, waterproofing before backfill
- Existing conditions at project start — site survey photos documenting pre-existing conditions
- Deliveries — materials received, condition of delivery, quantities
- Notable site events — unusual weather, accidents, property damage
- Progress milestones — percent complete documentation for billing
- Defects discovered — sub defects, material failures, damage
- Owner-furnished items and conditions — anything the owner provides that might later be claimed as defective
Photo documentation best practices:
- Date-stamp all photographs (most smartphone cameras embed EXIF data with date and GPS coordinates automatically — don't turn this off)
- Organize by project and date — a folder of 3,000 undated, unorganized photos is nearly useless in a dispute
- Caption significant photographs at the time they're taken — what it shows, why it matters

- Subcontractor prequalification records — financial statements, safety records, references
- Executed subcontracts — signed by both parties, all exhibits
- Certificates of Insurance — current COI for every policy year the sub is active
- Sub payment applications — all invoices submitted
- Lien waivers — conditional and unconditional, all periods, all sub tiers
- Sub change orders
- Sub performance documentation — written warnings, recovery plans, back-charges
- Sub certified payroll (prevailing wage projects)
Why sub lien waiver retention matters: If a supplier sues the owner claiming the GC's sub didn't pay for materials used on the project, the GC's defense is the lien waiver chain proving the sub was paid and waived lien rights. Without the waiver records, the GC may be forced to pay twice — to the owner for the withheld payment and to the supplier on the lien claim.
Retention: 7–10 years. Lien exposure can survive project completion for several years in most states.
Category 10: Closeout Records
The final project record — evidence that the work was completed per the contract.
What to retain:
- Certificate of Substantial Completion — signed and dated
- Certificate of Final Completion
- Certificate of Occupancy (or equivalent) from the authority having jurisdiction
- Punch list — original list, all updates, final sign-off by owner
- Final lien waiver — GC's unconditional final lien waiver to the owner
- All sub and supplier final unconditional lien waivers
- Warranty documentation file — all manufacturer warranties, GC warranty letters, sub warranties
- Operation and maintenance (O&M) manuals
- As-built drawings
- Training records — owner/occupant training performed by GC or subs
- Final payment confirmation
Why the Certificate of Substantial Completion matters: Substantial Completion is the legal trigger for the warranty period start date, the date from which the statute of limitations begins running on many claims, and the point at which risk of loss typically transfers to the owner. The signed certificate, with its specific date, is a critical legal document.
Retention: Permanent for closeout certificates and final lien waivers. Full document set for 10+ years.

Statute of repose: Many states have a statute of repose for construction defects — typically 6–12 years from substantial completion — after which claims are barred regardless of discovery. Retain all records for at least as long as the applicable statute of repose in your state.
Digital Records: Organization and Backup
Physical paper records are vulnerable — fire, flood, theft, and simple loss are real risks on an active job site. Digital records are the standard.

Relying on verbal communication Verbal directions, verbal approvals, verbal change authorizations — none of these create a record. Every significant communication gets followed up with a written confirmation.
Incomplete daily reports Daily reports that say "work continued" provide no evidentiary value. Specific crew counts, specific scope items, specific visitor names, specific problems — that's the record that matters.
Disorganized photo archives 3,000 undated photos in a single folder, named "IMG_4721.jpg," are nearly useless. A well-organized, date-stamped, captioned photo archive is a powerful tool in any dispute.
Deleting project emails when an employee leaves When the project manager changes, their project emails must be archived and retained — not deleted with the account. Establish a process for email preservation when personnel change.
Not sending formal notices The contract requires written notice of delay events, changed conditions, and claims within specified time windows. Missing a notice deadline can waive the claim entirely, regardless of merit.
Keeping records in one place A project file stored only on a job site computer, only in a filing cabinet in the site trailer, or only on a personal employee laptop is one event away from being lost. Redundant backup is not optional.
