Construction Warranty Letter Template: What to Warrant, For How Long, and How to Write It

Contractors who deliver a formal warranty document at project closeout report 31% higher client satisfaction scores and 40% more referrals than those who rely on verbal warranties, according to a 2025 GuildQuality survey.
Without a written warranty, you have no defined scope, no time limit, and no exclusions. A client can call two years later about a drywall crack and argue it's your responsibility. With a written warranty, you have a document that defines exactly what you stand behind, for how long, and what voids it.
What a Construction Warranty Covers

- Workmanship Warranty — quality of your labor and installation. Tile cracked from improper substrate prep = workmanship. Defective tile from the manufacturer = materials.
- Materials Warranty — materials you supplied were defect-free at installation. Typically 1 year, after which manufacturer warranty takes over.
- Pass-Through Manufacturer Warranties — roofing shingles, windows, HVAC equipment (5–30 years). Your job is to document and transfer these at closeout.
The implied warranty problem: Most states impose an implied warranty of habitability and workmanship on residential construction even without a written agreement. A written warranty with clear terms is always better than relying on implied standards courts interpret inconsistently.

SECTION 1 — WORKMANSHIP WARRANTY
Contractor warrants all labor and workmanship against defects for one (1) year from Substantial Completion. Contractor shall repair or replace defective workmanship at no cost upon written notice within the Warranty Period.
Structural components are warranted against structural defects for ten (10) years from Substantial Completion.
SECTION 2 — MATERIALS WARRANTY
All Contractor-supplied materials warranted as new, defect-free, and per spec for one (1) year. After one year, manufacturer warranties apply.

SECTION 5 — EXCLUSIONS
This warranty does not cover: (1) normal wear and tear; (2) owner modifications after completion; (3) damage from failure to perform maintenance; (4) Acts of God; (5) pre-existing conditions outside contract scope; (6) owner-furnished materials; (7) design defects from owner/architect; (8) consequential or incidental damages; (9) work outside original contract scope.
SECTION 6 — CLAIM PROCEDURE
- Notify Contractor in writing describing defect and location
- Contractor acknowledges within 3 business days
- Contractor inspects within 10 business days
- Covered defects repaired within 30 days of inspection
- Emergencies (active water intrusion, electrical hazard): 24–48 hours
Oral claims will not be accepted. Written notice required.
SECTION 7 — OWNER MAINTENANCE
To preserve coverage, Owner agrees to: replace HVAC filters every 1–3 months; clean gutters twice annually; inspect and re-caulk exterior annually; maintain positive drainage away from foundation.
SECTION 8 — LIMITATION OF LIABILITY
Contractor's maximum liability under this warranty shall not exceed the original contract price. Limited to repair or replacement — no consequential damages.

Where Warranty Claims Come From

Managing drywall claims (28% of all claims): Set expectations at closeout — minor hairline settling cracks are not a defect. Define in your warranty what constitutes a covered crack (wider than 1/8", structural cracks, cracks at window/door corners). Offer a 90-day touch-up visit as a goodwill gesture — this resolves most complaints before they become disputes.
Warranty Reserve by Project Type

Set aside warranty reserve from every job. At closeout, transfer 1–2% of contract value to a dedicated warranty account. Draw from it for claims. After the warranty period, transfer the balance to profit.
