Construction Safety Plan: OSHA Requirements and How to Build One

OSHA fined construction contractors $196 million in 2023 — and that's just federal citations, not state-plan states. The average OSHA serious violation in construction carries a penalty up to $16,131 per violation. A single fall fatality can trigger $161,323 in willful violation penalties per citation, plus state penalties, civil litigation, and workers compensation costs that dwarf the OSHA fine. Beyond the financial exposure, the construction industry has one of the highest fatality rates of any industry — approximately 1,000 fatal work injuries per year, accounting for nearly 1 in 5 worker deaths nationally.

A construction safety plan isn't a compliance document to file in a binder — it's an operational system for identifying hazards before workers encounter them, training workers to recognize and avoid those hazards, and documenting that the system was followed. The contractors with the lowest Experience Modification Rates (EMR) and the fewest OSHA citations don't get lucky — they have better safety management systems than their competitors.

OSHA Construction Standards: What Applies

Construction work is governed by 29 CFR Part 1926 — OSHA's construction industry standards. General industry standards (29 CFR Part 1910) apply to construction only where 1926 has no specific provision.

The General Duty Clause (Section 5(a)(1) of the OSH Act): Even where no specific standard exists, employers must provide employment free from recognized hazards that are causing or likely to cause death or serious physical harm. OSHA uses this clause for hazards not covered by specific standards.

Fall protection is the #1 citation category every year. Four causes account for the majority of construction fatalities: falls, struck by object, electrocution, caught in/between — OSHA's "Fatal Four."

Two Levels of Safety Planning

Company Safety Program: The overall safety management system for the contractor's business — written policies, training requirements, disciplinary procedures, incident investigation process. Applies to all projects.

Site-Specific Safety Plan (SSSP): A project-specific document that identifies the particular hazards of this project — the site layout, the specific trades, the specific risks — and documents the controls in place. Required on most commercial projects; required by the contract on most public and institutional work.

Both are required. The company safety program provides the foundation; the SSSP applies it to the specific job.

Required Elements of a Construction Safety Plan

1. Safety Policy Statement

Signed by company leadership — establishes that safety is a company priority, defines management accountability, and commits company resources to the program. One page. Must be signed, dated, and communicated to all workers.

2. Hazard Identification and Risk Assessment

Before work starts on any activity, identify:

  • What are the hazards? (Falls, electrical, struck-by, pinch points, hazardous materials)
  • How severe is the potential injury? (Minor, serious, fatal)
  • How likely is the hazard to cause injury without controls?
  • What controls reduce or eliminate the hazard?

Hierarchy of controls (highest to lowest effectiveness):

  1. Elimination — remove the hazard entirely
  2. Substitution — replace with less hazardous alternative
  3. Engineering controls — guards, ventilation, GFCI protection
  4. Administrative controls — work procedures, permits, scheduling
  5. PPE — last line of defense, not first

Job Hazard Analysis (JHA): A written breakdown of a specific task — step by step — identifying the hazard at each step and the required control. Required before high-hazard activities. Workers performing the task participate in the JHA development.

3. Required Safety Programs

These specific written programs are required by OSHA where the hazard exists on the project:

Fall Protection Program (1926.502):

  • Required when workers work at 6 feet or more above a lower level
  • Identifies all fall hazards on the project
  • Specifies controls: guardrail systems, safety net systems, personal fall arrest systems (PFAS)
  • Competent person for fall protection designated by name

Hazard Communication Program (HazCom / 1910.1200):

  • Required wherever hazardous chemicals are present
  • Chemical inventory list
  • Safety Data Sheets (SDS) accessible to all workers
  • Container labeling requirements
  • Worker training documentation

Personal Protective Equipment Program (1926.95–.106):

  • Hazard assessment for PPE (written certification required)
  • PPE specified by task and hazard
  • Fit testing (for respirators — separate written program required)
  • Training documentation

Lockout/Tagout (LOTO) Program (1910.147 / 1926.417):

  • Required where workers may be exposed to energy during equipment servicing
  • Equipment-specific energy control procedures
  • Authorized employee training documentation

Confined Space Program (1926.1200):

  • Required where permit-required confined spaces exist on the project
  • Identification and permit system
  • Entry procedures, atmospheric testing, rescue procedures

Electrical Safety (1926.400–449):

  • GFCI protection requirements
  • Extension cord inspection and replacement procedures
  • Assured Equipment Grounding Conductor Program (alternative to GFCI)

Crane and Rigging (1926.1400–.1442):

  • Operator qualification documentation
  • Annual crane inspection records
  • Pre-shift inspection checklist
  • Lift plan for critical lifts

4. Toolbox Talks

Brief daily or weekly safety meetings — 5–15 minutes — covering a specific hazard relevant to current work. Required by OSHA under 1926.21 (safety training and education) and a standard requirement in most commercial contracts.

Documentation requirements:

  • Date
  • Topic
  • Presenter name
  • Attendee signatures

Construction time keeping app and toolbox talks: When toolbox talks are conducted during paid work hours (as they must be), those minutes are part of the workers' daily hours. Tracking the time separately — using a toolbox talk cost code — documents both that the training occurred and its cost, which feeds the true cost of the safety program into job cost.

Toolbox talk frequency:

  • Daily: High-hazard activities (crane lifts, excavation, confined space entry)
  • Weekly: Standard commercial projects
  • As-needed: Before new activities, after a near-miss or incident

5. New Worker Safety Orientation

Every worker — employee or subcontractor — must complete a safety orientation before starting work on the project. Orientation must be documented.

Orientation content:

  • Emergency procedures: evacuation routes, muster point, emergency contacts
  • Site hazards specific to current conditions
  • PPE requirements and where to obtain PPE
  • Incident reporting procedure — how to report, to whom
  • Site rules: drug and alcohol policy, housekeeping standards
  • Toolbox talk schedule and attendance requirements

Sign-off sheet: Worker name, date, topics covered, worker signature, presenter signature. Retained in the project safety file.

Construction time tracking for workers records the first clock-in date — if a worker's first time record predates their orientation documentation, that's an OSHA compliance gap. Orientation before first clock-in is the standard.

6. Incident Reporting and Investigation

OSHA recordkeeping requirements (1904):

Employers with 10+ employees in construction must maintain:

  • OSHA 300 Log: Annual log of all work-related injuries and illnesses that meet recording criteria
  • OSHA 300A Summary: Annual summary of 300 Log posted February 1–April 30 each year
  • OSHA 301 Incident Report: Individual report for each recordable incident within 7 days

Recordable incidents — must go on the 300 Log:

  • Work-related fatality
  • Work-related injury or illness resulting in: days away from work, restricted work, job transfer, medical treatment beyond first aid, loss of consciousness, diagnosis of a significant injury or illness

OSHA-reportable incidents — must be reported directly to OSHA:

  • Fatality: Report within 8 hours
  • Inpatient hospitalization (any number): Report within 24 hours
  • Amputation: Report within 24 hours
  • Loss of an eye: Report within 24 hours

Incident investigation process: Every recordable incident and every near-miss should be investigated — not to assign blame, but to identify the root cause and prevent recurrence.

Investigation steps:

  1. Secure the scene — preserve evidence, prevent further injury
  2. Provide medical attention for injured worker immediately
  3. Document the scene — photographs, measurements, witness statements
  4. Root cause analysis — what was the chain of events? What failed? (Equipment failure, procedure failure, training failure, supervision failure)
  5. Corrective action — what changes prevent recurrence?
  6. Document and communicate findings to the crew

Investigation hours tracked separately: Incident investigation time tracked to a safety cost code in the contractor time tracking app documents the true cost of incidents — separate from production labor. 7. Emergency Action Plan (EAP)

Required for all construction sites (1926.35). Must be written (if 11 or more employees) and cover:

  • Emergency escape procedures and routes — site-specific, posted at job site
  • Procedures for workers who remain to operate critical operations before evacuating
  • How to account for all workers after evacuation — muster point, headcount
  • Rescue and medical duties for designated workers
  • Preferred means of reporting fires and other emergencies
  • Names and contact info of persons who can provide further information

Post the EAP at the job site trailer. Review it at new worker orientation.

Subcontractor Safety Management

The GC is responsible for overall site safety — including subcontractor workers. OSHA cites GCs for hazards created by subcontractors that the GC knew about or should have known about.

Subcontractor safety requirements:

  • Pre-qualification: Review sub's safety record (EMR, OSHA citations, incident rate) before awarding work. See Construction Workers Compensation: How to Lower Your EMR for EMR context. High EMR subs bring high-risk workers and practices to the GC's job site.
  • Sub safety plan submission: Require each sub to submit their safety plan before mobilization
  • Sub worker orientation: All sub workers complete the same site orientation as direct employees
  • Sub participation in toolbox talks: Sub foremen participate in, or conduct, daily toolbox talks for their crews
  • GC authority to remove unsafe workers: Include in subcontracts — the GC has the right to remove any sub worker creating an unsafe condition

The chain of liability: GC → Sub → Sub-sub. OSHA can cite any tier. The GC's contract should flow down safety requirements to all sub tiers and require each sub to do the same.

Safety Inspection and Audit

Daily site inspection: Superintendent or safety officer walks the entire site daily — before work starts or at the beginning of the shift. Documents hazards found, corrective actions required, and by whom.

Inspection documentation:

  • Date and inspector name
  • Area inspected
  • Hazards identified
  • Required corrective action
  • Responsible party
  • Completion date (for tracking open items to closure)

Monthly safety audit: More comprehensive review of the entire safety program — documentation, training records, PPE condition, equipment inspection records, toolbox talk logs. Identifies systemic gaps, not just field hazards.

Third-party safety audit: Some owners, insurers, and bonding companies require annual third-party safety audits. A safety consultant reviews the written program, interviews workers, walks the site, and produces a findings report. Use the findings to improve the program — don't file the report without action.

EMR, Workers Comp, and Safety Performance

The Experience Modification Rate (EMR) is the single most important metric for a contractor's safety performance — it directly affects workers compensation premium, bid eligibility (many GCs and owners won't award to contractors with EMR above 1.0), and bonding capacity.

EMR calculation uses payroll hours from the workers compensation policy. Total payroll hours — from the construction time sheet app — must match what's reported to the workers comp carrier. Accurate payroll classification by worker type (carpenter vs. laborer vs. ironworker) is essential because misclassification in either direction creates premium errors and audit findings.

Reducing EMR through safety program:

  • Every recordable incident pushes EMR up — fewer incidents = lower EMR
  • Return-to-work programs reduce lost-time claims (the most expensive EMR driver)
  • Safety training documentation demonstrates proactive hazard management
  • Pre-hire safety screening reduces incidents from high-risk workers

Willful violation: OSHA determines the employer knew about a hazard and made no reasonable effort to eliminate it. Highest penalties. Criminal referral possible in fatal cases — willful violation causing a worker death can result in a misdemeanor charge, imprisonment up to 6 months, and fines up to $250,000 for individuals.

Repeat violation: The employer was previously cited for a substantially similar hazard within the last 5 years. Maximum penalty.

Multi-employer citation policy: OSHA can cite creating employers (who created the hazard), exposing employers (whose workers are exposed), correcting employers (who are responsible for correcting), and controlling employers (who have general supervisory authority) — the GC can be cited for a sub's hazard.
